With on-screen Bajrangi Bhaijaan’s acquittal, could we still rely on the “temple of justice” – Indian Judiciary ?
Article 14 of the Constitution of India states that – “All are equal before law”. Let’s analyze whether it is actually the case with our judiciary.
These days most of the people discuss the story of Mahatma Gandhi wherein he escaped his friend from a fake case and the friend expressed worries as to what would happen later, as in when Gandhi wouldn’t be there to fight the cases of innocents selflessly; to which Gandhiji replied that his photo printed on Indian currency notes will help the people get rid of such cases.
Is it mere sarcastic coincidence when we find innocents ensnared in fake cases, or is it a result of intentional well-planned plot ?
Let’s discuss as to how the judicial system is manipulated according to the needs of those considered as celebrities; notwithstanding anything contained in it, we have full faith in our judicial system.
Industrial terrorism took place 31 years back when the incident of Bhopal gas tragedy (leakage of methyl isocyanate – MIC gas) took place at Union Carbide India Limited (UCIL). The victims of the tragedy got nothing in the name of justice; despite the fact that the CEO of the company – Warren Anderson was responsible for this incident of killing thousands of people and exposing over 500,000 people to MIC gas along with other toxic chemicals; who got “State Guest” treatment by the then Government of Madhya Pradesh. Imprisonment could never be expected of such accused whose bail was arranged within no time by our own responsible people, planted in the system to support those who dare to commit crimes just because of such loopholes of the laws and provider thereof. Extradition also didn’t happen. He spent his life in Florida in leisure & luxuries and died naturally, without facing litigation; but the aggrieved in this case are still coping up with repercussion in terms of health and wealth.
Recently, Indian Cine star Salman Khan (Bhai), charged of ‘culpable homicide’ (murdering 6 people while driving late night in drunken state) in ‘Hit And Run Case’ (no personal grudges as such, but writing on behalf of public who suffered a lot by the decision) got acquitted after 13 years of judicial drama despite hundreds of statements by the witnesses; but as the Hero wins at the end the story of any film, he won the case showing gratitude to all his fans, family, lawyers etc. How the evidence turned into fake is a mystery. How his ‘being alcoholic’ converted into ‘being human’, nobody knows. How his then “drunk-driving” changed into “not driving the car” is secrecy for all of us. It is said that the victims (witnesses) lying on the footpath were threatened in such a manner that those (who entered Mumbai with dreams in eyes and would never probably dare to dream) left Mumbai shortly in order to save their skins; and could not even get compensation, and rather faced danger to their lives. Interestingly, when judgment of Bhai’s imprisonment came, his bail was granted even after the hours of court, what is never to be seen in the matters of ordinary people. The fine investigations that took place in this case never happen in the cases of ordinary people so minutely. It’s quite surprising that he was not kept in jail even for a single day and was granted bail even after the court hours, which has never happened till date with general public. If deceased police personnel witnessing was suspicious, why the statement of the driver became worth considering after 12 years? High Court has said that the investigation was not done properly, whether the court will impose any stringent action on the police for not investigating the things properly as in the case of Sheena Bora, is still something that is quite suspicious. Investigation via SIT by lodging FIR for main witness in the incident of Constable Ravindra Patil’s demise (who was then body-guard of Salman Khan) will certainly ensure the safety of witnesses and morale support of the police.
While the court is considering keeping the Nirbhaya gang rape accused due to its cahoots with anti-national elements in the jail ( reports says) after completion of his punishment period; under national security law, judgment in case of Cine star Salman Khan has certainly derided the system.
Fodder scam mastermind – Lalu Prasad Yadav, got released on bail while he was given 5 years imprisonment. Rapist Tarun Tejpal (former editor-in-chief of Tehelka magazine) was released on bail despite the allegations of rape corroborated and was not imprisoned.
Let’s take a look at the list of those imprisoned for long, despite being innocent is as follows:-
Sadhvi Pragya Singh Thakur, is said to be involved in Malegaon bomb blasts, but no allegation has been proven so far; yet she had to face inhumane treatment of the cops, on top, poisonous substances were injected into her body that caused carcinoma to her. She, despite her innocence, has been living in jail for past 7 years.
Narayan Sai:-Allegation of rape is leveled against him, which has not been proven as yet, is still in the jail due to judicial dismay.
Saint Shri Asharamji Bapu:-Allegation of rape is leveled against a venerable saint, which in its entirety is baseless and frivolous. Jodhpur DCP – Ajaypal Lamba has said that there is no commission of rape on the alleged girl, nor any other evidence of the saint being rapist has been substantiated by any Women Law Commission or in any manner whatsoever. Bholanand has disclosed the malafide intents of conspirators who demanded money from Bapuji, failing which they complicated His life by such a fake litigation, by killing witnesses time to time. The matter of concern here is – why any action against such conspirators has not been taken so far by those who are questioning the character of a revered saint and whose own characters are not known to the public ?
Disappointed with the judicial procedures for not supporting those who abide by the laws every time, the saint is planning to go on hunger fast till death. Will this system give the honorable saint justice, who in terms of Parents’ Worship Day, by Yuva Sewa Sangh, by Gurukuls and by uplift of women via Mahila Utthan Mandal; used to give discourses sessions at three different places a day, so as to elevate the youth, the nation and the whole mankind throughout the world without discrimination, despite His adverse health conditions and is now suffering in this manner. Should we watch this whole scene quietly, leaving it in the hands of judiciary without showing any concerns ?
In the present era, role of judiciary have become suspicious. It is not an exaggeration that the judiciary is playing role in converting ordinary persons into culprits by giving justice only to the affluent and celebrities, while innocents are suffering in the prisons; thus it is supporting mischiefs, mishaps and terrorism in turn.
